The 14-page fraud lawsuit claims that despite the beauty products’ explicit representations about the ingredient, OSEA’s Collagen Dream Night Cream and Undaria Collagen Body Lotion do not contain collagen at all. Instead, the case says, the items are made with cocoyl hydrolyzed collagen, a plant-based “imitation” of the ingredient.
Collagen, an animal protein found primarily in connective tissue, is decidedly not plant-based, the suit points out. Although cocoyl hydrolyzed collagen is used to mimic some of collagen’s benefits, the case asserts that this “fake imitation” is a highly processed ingredient extracted from plants such as nicotiana benthamiana, a relative of the tobacco plant.
The complaint alleges that OSEA seeks to capitalize on consumer demand for beauty and skincare products that contain collagen, which is widely used in cosmetics due to its perceived anti-aging effects.
The filing contends that the beauty brand has used the plant-based substitute in place of collagen in an attempt to cut costs, as true animal collagen is more expensive to produce and process than its synthetic imitation.
As a result of the alleged misrepresentations, OSEA has unfairly profited at the expense of consumers, the class action suit charges.
The OSEA lawsuit looks to represent anyone in the United States who, during the applicable statute of limitations period, purchased the products listed on this page for personal or household purposes, and not for resale.
