According to the 78-page lawsuit against manufacturer Beiersdorf, Inc., prominent front-label statements such as “99% Natural Origin Ingredients” and “98% Naturally Derived Ingredients,” coupled with vibrant plant imagery, lead consumers to believe the skincare products contain high percentages of ingredients from natural sources. However, the suit claims that despite the overt representations, the items consist almost entirely of synthetic ingredients.
The case contends that only a few of the components in the products’ respective ingredient lists are actually derived from nature, such as water, alcohol, avocado oil and potentially xanthan gum. The rest of the products’ ingredients are synthetic chemicals and compounds manufactured through industrial processing, the complaint alleges.
“For example, of the 20 ingredients listed for the ‘Nourish by Nature’ Avocado Enriched Lotion, 12 are industrially-produced chemicals that most consumers would not identify as ‘natural’ or ‘naturally derived,’” the filing says.
Although certain ingredients, such as glycerin and citric acid, can occur naturally, they are manufactured synthetically when needed for large-scale commercial products, the Nivea lawsuit explains.
The suit argues that the “natural” representations are deceptive because the advertised proportions are calculated using a method that is inappropriate for product labeling and marketing purposes.
The case accuses the manufacturer of “greenwashing” the skincare items in a bid to make them seem safer and more eco-friendly and capitalize on growing demand for “natural” products.
At issue in the complaint are all varieties of Nivea “Nourish by Nature” and “Naturally Good” body lotions, moisturizers and related skincare products, including, without limitation:
