Nearly $4.1M Costa Del Mar Settlement Resolves Lawsuit Over Sunglasses Warranty Repair Fees

Costa Del Mar has agreed to a $4,095,000 settlement to resolve a lawsuit that alleged the company sold sunglasses backed by a purported “lifetime warranty” while unlawfully requiring consumers to pay an additional fee to repair or replace sunglasses damaged by a manufacturer’s defect.

The Costa Del Mar warranty class action settlement received preliminary approval from the court on August 17, 2026. Eligible to participate in the settlement are all United States citizens who purchased a pair of non-prescription Costa Del Mar sunglasses prior to January 1, 2016 and paid the company a warranty fee to repair or replace those sunglasses damaged by a manufacturer’s defect from August 20, 2013 to February 29, 2020.

Costa Del Mar settlement class members do not need to take action to automatically receive a pro rata (equal share) cash payment for each eligible warranty repair made during the relevant time period.

Class members who wish to select a payment method can head to this page and enter the unique ID and PIN found on their copy of the settlement notice. Class members who do not choose a payment method will be mailed a paper settlement check.

The court will determine whether to grant final approval to the Costa Del Mar settlement following a hearing on January 20, 2027. Compensation will be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Costa Del Mar class action lawsuit alleged that Costa sold sunglasses backed by a purported “lifetime warranty” for manufacturer’s defects yet charged consumers an additional $11.95 processing fee, plus tax, per warranty claim for repair or replacement of sunglasses damaged by a defect, in violation of the federal Magnuson-Moss Warranty Act.
