The Mental Health Association class action settlement received preliminary approval from the court on July 24, 2026. Eligible to participate in the settlement are all individuals whose private information was accessible because of the Mental Health Association data breach that occurred on or around November 28, 2024.
Court documents state that approximately 12,633 people were impacted by the cyberattack.

Class members who submit a valid, timely claim form can receive up to $5,000 in reimbursement for documented out-of-pocket losses incurred between November 28, 2024 and November 19, 2026 due to the data breach. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs and more.
Mental Health Association class members must submit proof, such as bank statements or receipts, to receive a documented-loss payout.
Class members seeking a documented-loss payment can also file a claim for reimbursement of up to three hours of lost time spent responding to the data incident, at a rate of $25 per hour. This benefit covers activities such as changing passwords, investigating suspicious account activity and researching the data breach.
In lieu of a documented-loss and/or lost-time payout, class members can file a claim form for a $40 cash payment, with no proof required.
All cash payments may be reduced on a pro rata (proportional) basis if the total value of the claims exceeds $300,000.
Lastly, all class members are eligible to enroll in three years of free credit monitoring through CyEx Identity Defense Complete, which includes identity theft insurance, dark web scanning, public records monitoring and more.
To submit a Mental Health Association claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
Mental Health Association settlement claim forms must be filed online or by mail by November 19, 2026.
The court will decide whether to grant final approval to the Mental Health Association data breach settlement following a hearing on December 15, 2026. Settlement benefits will be made available after the deal receives final approval and any appeals are resolved.
The data breach lawsuit alleged that Mental Health Association failed to adequately protect sensitive information from unauthorized access. The case claimed that the data impacted in the incident may have included names, addresses, Social Security numbers, medical diagnoses/conditions, medication details, medical record numbers and more.
