International Shoppes Class Action Settlement Ends Litigation Over 2023 Cyberattack

An International Shoppes settlement offers cash and credit monitoring to individuals whose info was compromised in a Nov. 2023 data breach.
International Shoppes, LLC and Diplomatic Duty Free Shops of New York, Inc. have agreed to a class action settlement to end litigation that alleged the duty-free and specialty retailers failed to protect sensitive information from a November 2023 cyberattack.

The International Shoppes class action settlement received preliminary approval from the court on July 14, 2026. Eligible to participate in the settlement are all United States residents whose personal information was compromised in the data breach discovered by International Shoppes in December 2023, including all who received notice of the incident.
Court documents state that approximately 5,382 people are included in the settlement class.

Class members who file a timely, valid claim form can receive up to $4,000 for documented out-of-pocket losses incurred between November 16, 2023 and November 11, 2026 because of the data breach. This benefit covers losses from identity theft and fraud and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs, postage, and more.
Class members must submit proof, such as bank statements or receipts, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can submit a claim form to receive an estimated $50 cash payment, with no proof required.
Should the total amount of all payments to class members exceed the $500,000 aggregate benefits cap, all payments will be reduced on a pro rata basis.
Lastly, all class members can elect on their claim form to receive two years of CyEx Financial Shield Complete, which includes financial fraud insurance, one-bureau credit monitoring, and monitoring for fraud or identity theft and unauthorized transactions.
To submit an International Shoppes settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All International Shoppes settlement claim forms must be submitted online or postmarked by November 11, 2026.
The court will decide whether to grant final approval to the International Shoppes settlement following a hearing on November 16, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The International Shoppes class action lawsuit alleged that the duty-free and specialty retail companies failed to implement reasonable cybersecurity measures to protect private information from a cyberattack that occurred in November 2023.
According to court documents, confidential information that may have been compromised during the data breach included names, addresses, dates of birth, Social Security numbers, driver’s license and passport information, financial account numbers, and health information.
