Fort Wayne Medical Education Program Settlement Ends Data Breach Lawsuit Over December 2024 Incident

Fort Wayne Medical Education Program has agreed to a class action settlement to resolve a lawsuit that alleged the family medicine residency program failed to protect confidential information from a targeted cyberattack in December 2024.

The Fort Wayne Medical Education Program class action settlement received preliminary approval from the court on July 29, 2026. Eligible to participate in the settlement are all individuals whose private information was potentially compromised as a result of the December 2024 data breach and who are included in the settlement class list generated by Fort Wayne Medical Education Program.

Settlement class members who submit a timely, valid claim form can receive up to $500 for documented “ordinary” out-of-pocket losses incurred between December 12, 2024 and October 27, 2026 due to the data breach. This benefit covers costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs, postage, and more.

In addition, class members can file a claim form to receive up to $5,000 for documented “extraordinary” out-of-pocket losses incurred during the same time period due to the breach. This benefit covers losses from identity theft or fraud that are not already covered by another settlement benefit.

Class members must submit proof, such as receipts, to receive a documented-loss payment. 

Further, class members can file a claim form to receive reimbursement for up to four hours of lost time spent responding to the data breach, at a rate of $20 per hour. This benefit covers activities like changing passwords, investigating suspicious account activity, and researching the Fort Wayne Medical Education Program cyberattack.

Payments for lost time will count toward the $500 cap for out-of-pocket loss payments.

In addition, class members can elect on their claim form to receive either credit monitoring or medical data monitoring services.

Class members whose Social Security numbers may have been compromised during the cyber incident are in Group 1 and eligible to receive two years of CyEx Financial Shield Complete, which includes financial fraud insurance.

Class members whose Social Security numbers were not impacted by the cyberattack are in Group 2 and eligible to receive two years of CyEx Medical Shield Complete, which includes medical identity theft insurance.

In lieu of any other settlement benefits, class members can submit a claim form to receive a $40 cash payment, with no proof required.

To submit a FWMEP settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All FWMEP settlement claim forms must be submitted online or by mail by October 27, 2026.

The court will determine whether to grant final approval to the FWMEP data breach settlement following a hearing on December 7, 2026. Settlement benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Fort Wayne Medical Education Program class action lawsuit alleged that the Indiana-based accredited family medicine residency program failed to implement adequate cybersecurity measures to protect confidential information in its care from a December 2024 data breach.

Court documents state that information that may have been compromised in the breach included personally identifiable information and protected health information.
