EMM Loans Settlement Ends Class Action Lawsuit Over February 2024 Data Breach

An EMM Loans settlement offers cash and credit monitoring to individuals impacted by a February 2024 data breach.
EMM Loans, LLC has agreed to a settlement to wrap up a class action lawsuit that alleged the residential mortgage lender failed to protect current and former customers’ sensitive information from a February 2024 data breach.

The EMM Loans class action settlement received preliminary approval from the court on April 17, 2026. The settlement covers all United States residents whose personally identifiable information was implicated in the data breach discovered by EMM in February 2024, including all who received notice of the incident.
Court documents state that approximately 2,313 people are covered by the class action settlement.

EMM Loans settlement class members who file a valid, timely claim form can receive up to $4,000 for unreimbursed out-of-pocket losses stemming from the breach. This benefit covers the costs of credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs, expenses related to identity theft or fraud, and other out-of-pocket losses.
Class members must provide proof, such as receipts or bank statements, to receive an out-of-pocket-loss payment.
Class members can also file a claim to receive compensation for up to three hours of lost time spent responding to the breach, at a rate of $30 per hour, subject to the $4,000 payout cap.
In lieu of a payout for out-of-pocket losses and lost time, class members can instead file a claim form to receive a $50 alternative cash payment, with no proof required.
Finally, in addition to either monetary relief option, all class members can file a claim to receive an enrollment code for two years of CyEx Financial Shield Complete, which includes two-bureau credit monitoring and financial fraud insurance.
To file an EMM Loans settlement claim form online, class members can head to this page and log in using the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out, and return by mail to the settlement administrator.
All EMM Loans settlement claim forms must be submitted online or by mail by August 17, 2026.
The court will determine whether to grant final approval to the EMM Loans data breach settlement following a hearing on August 24, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The EMM Loans class action lawsuit claimed that the New Jersey-based residential mortgage lender failed to implement proper cybersecurity measures to protect the sensitive information of current and former customers, which allegedly led to a data breach discovered by the company on or around February 12, 2024.
Per court documents, private information that may have been exposed during the cyberattack included names, Social Security numbers, driver’s license and state identification numbers, and passport numbers.
