A proposed class action lawsuit alleges that Beiersdorf Inc. deceptively charges more for its Eucerin Baby Eczema Relief Cream even though the product is essentially identical in formulation to the company’s regular Eucerin Eczema Relief Cream.

The 18-page complaint contends that Beiersdorf promotes that its baby eczema cream is a distinct product specially formulated for infants to justify charging a roughly 35-percent price premium over the standard Eucerin eczema cream.
According to the class action lawsuit, the company’s labeling conveys that its baby cream is uniquely designed for infants through the prominent use of terms such as “Baby,” claims like “Pediatrician Recommended,” and imagery of babies and animals.
“Beiersdorf’s marketing does more than merely suggest that the Baby Product is suitable for infants: it conveys to reasonable consumers that the Baby Product is specially formulated, and therefore uniquely appropriate for use on babies, and, by implication, that the Adult Product is not,” the complaint states.
The suit states, however, that the two products have the same active ingredient, colloidal oatmeal, at the same one percent concentration, and identical inactive ingredients listed in the same order. Furthermore, the case mentions that the products share the same application directions, warnings, indications and restrictions.
“The only difference is the addition of ‘Baby’ representations and related vignettes on the Baby Product’s label,” the filing asserts.

The lawsuit argues that there is “no rational, economic reason” for consumers to pay more for what are materially identical products. According to the complaint, a five-ounce container of Eucerin Eczema Relief Cream retails for $9.78 at Walmart, whereas the same-size Eucerin Baby Eczema Relief Cream is $13.19.
Although the back label of the baby cream states in fine print that it contains the “[s]ame trusted formula as Eucerin Eczema Relief Cream,” the case argues that this disclosure is insufficient to correct the allegedly misleading impression created by the product’s front-label marketing. The complaint contends that consumers are unlikely to notice the statement before purchase and are not informed that they can buy the same product for less.
The lawsuit alleges that Beiersdorf’s marketing allows the company to charge a premium for a product that has no meaningful formulation differences or added benefits, in violation of California consumer protection law.
The Eucerin class action lawsuit seeks to represent all individuals in California who purchased the “Eucerin Baby” Eczema Relief Cream for personal or household use, and not for resale, at any time from four years before the filing of the complaint on June 29, 2026 to the date a class is notified.
