Auxilio Mutuo Hospital Settlement Resolves Data Breach Lawsuit Over 2023 Cyber Incident

Hospital Español Auxilio Mutuo de Puerto Rico, Inc., doing business as Auxilio Mutuo Hospital in Puerto Rico, has agreed to a class action settlement to resolve a lawsuit that alleged the facility failed to adequately protect current and former patients’ private information from a September 2023 data breach.

The Auxilio Mutuo Hospital class action settlement received preliminary approval from the court on August 24, 2026. Eligible for the settlement are all United States residents whose personal information may have been accessed and/or acquired by an unauthorized party as a result of the cybersecurity incident experienced by Auxilio Mutuo Hospital in September 2023. 

Court documents state that approximately 41,000 individuals are included in the settlement class.

The court-authorized Auxilio Mutuo Hospital data breach settlement website can be found at HospitalEspanolAuxilioSettlement.com.

Class members who file a timely, valid claim form can receive up to $2,500 for documented, unreimbursed out-of-pocket losses incurred between September 2023 and December 21, 2026 due to the data breach.

Class members must submit proof, such as receipts, to receive a documented-loss payment.

In lieu of a documented-loss payment, class members can file a claim form to receive a $25 cash payment, with no proof required.

Should the total value of all valid claims exceed $500,000, payments to class members may be reduced on a pro rata (proportional) basis.

Lastly, all class members have the opportunity to enroll in two years of one-bureau credit and medical monitoring, which includes fraud protection. Codes for credit and medical data monitoring were sent to class members as part of the settlement notice.  

To file an Auxilio Mutuo Hospital settlement claim form online, class members can navigate to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All Auxilio Mutuo Hospital settlement claim forms must be submitted online or postmarked by December 21, 2026.

The court will determine whether to grant final approval to the Auxilio Mutuo Hospital class action settlement following a hearing on January 20, 2027. Benefits will begin to be made available to class members only after final approval has been granted and any appeals have been resolved.

The Auxilio Mutuo Hospital class action lawsuit alleged that the Puerto Rico-based hospital failed to implement adequate cybersecurity measures to protect current and former patients’ sensitive information from a September 2023 data breach.

Court documents state that private information that may have been compromised during the data breach included names, dates of birth, Social Security numbers, driver’s license numbers, state identification numbers, passport numbers, financial and banking information, account numbers, billing codes, payment cards, medical information, and health insurance information.
