Akron Children’s Hospital has agreed to settle a class action lawsuit alleging it used third-party data tracking software to collect and share website visitors’ personal information without consent.

The Akron Children’s Hospital class action settlement received preliminary court approval on July 18, 2025 and covers approximately 313,700 Ohio citizens whose personal information may have been disclosed by Akron Children’s Hospital to third parties through the Meta Pixel or similar technology without authorization.

Akron Children's Hospital settlement class members who submit a timely, valid claim form will be eligible to receive a $19 cash payment and two years of identity theft and credit monitoring services, including $1,000,000 in identity theft insurance coverage, fully managed identity restoration and member advisory services, lost wallet assistance and CyberScan dark web monitoring.
To submit a claim form online, class members must visit this page of the settlement website and log in with the unique notice ID and confirmation code found in their copy of the settlement notice.
Alternatively, a PDF claim form is available to print, fill out and mail back to the address listed on the first page of the form.
All claim forms must be submitted or postmarked by September 29, 2025.
Akron Children’s Hospital has also agreed as part of the settlement to remove tracking pixels from its public-facing website, patient portals and any forms located on its public-facing site unless they are HIPAA-compliant or necessary for website functionality.
A hearing is set for October 10, 2025 to determine whether the settlement will receive final approval from the court. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Akron Children’s Hospital class action lawsuit alleged that the hospital used third-party analytics tools, including the Meta Pixel, on its websites to collect and disclose individuals’ personal information to Facebook and other third parties without consent.
