A $980K Berman & Rabin settlement offers cash and credit monitoring to individuals potentially affected by a July 2024 data breach.
Berman & Rabin, P.A. has agreed to a $980,000 settlement to wrap up a class action lawsuit that alleged the creditors’ rights law firm failed to protect the private information of individuals who transacted with its clients, leading to a July 2024 data breach.

The $980,000 Berman & Rabin class action settlement received preliminary approval from the court on May 1, 2026. The agreement covers all living individuals in the United States who received notice indicating that their private information was potentially compromised in the data breach.
Court documents state that approximately 151,944 people were impacted by the Berman & Rabin data breach.

Berman & Rabin settlement class members who file a valid, timely claim form can receive up to $3,500 for documented, unreimbursed losses incurred between July 8, 2024 and August 27, 2026 due to the cyberattack. This benefit covers losses arising from identity theft or fraud and the costs of credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs, and more.
Class members must submit proof, such as receipts, to receive a documented-loss payout.
In lieu of a documented-loss payment, class members can instead file a claim form to receive an alternative cash payment, with no proof required. The amount of each class member’s pro rata payment will depend on the total number of valid claims filed, among other factors.
In addition to either monetary relief option, all class members can file a claim form to receive an activation code for two years of CyEx Financial Shield Complete, which includes one-bureau credit monitoring and financial fraud insurance.
To file a Berman & Rabin settlement claim form online, class members can head to this page and enter the login ID and PIN listed on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out, and return by mail to the settlement administrator.
All Berman & Rabin settlement claim forms must be submitted online or by mail by August 27, 2026.
The court will determine whether to grant final approval to the Berman & Rabin data breach settlement following a hearing on September 11, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Berman & Rabin class action lawsuit claimed that the Kansas-based legal firm serving lenders and financial institutions failed to implement reasonable cybersecurity measures to safeguard its clients’ private information, which allegedly led to a data breach discovered by the firm in July 2024.
Per court documents, private information potentially compromised in the breach included names, Social Security numbers, drivers’ license numbers, financial information, medical information and health insurance information.
