An $825K BMS CAT settlement resolves a class action lawsuit over a February 2025 data breach.
BMS Holdings, LP, which does business as BMS CAT, has agreed to an $825,000 settlement to conclude a class action lawsuit that alleged the natural disaster recovery company failed to protect the sensitive information of current and former employees from a February 2025 data breach.

The $825,000 BMS CAT class action settlement received preliminary approval from the court on March 24, 2026. The settlement covers all individuals who were sent a notice letter from BMS CAT stating that their personal information may have been exposed in the February 2025 data breach.
Court documents state that the private information of 28,454 people was potentially accessed during the incident.

According to the website, BMS CAT settlement class members who file a valid, timely claim form can receive up to $5,000 for documented losses incurred between February 5, 2025 and July 8, 2026 due to the breach. Class members must submit proof, such as receipts, to receive a documented-loss payment.
Losses covered by this benefit include expenses related to identity theft and fraud; fees to obtain credit reports, credit monitoring or freeze/unfreeze credit; costs to replace IDs; and more.
In lieu of a documented-loss payment, class members may instead file a claim form to receive an estimated $100 cash payment, with no proof required. The final amount of this payout may increase or decrease, depending on the total number of valid claims filed.
In addition to monetary benefits, all class members may file a claim form to receive an enrollment code for three years of CyEx Financial Shield Complete, which includes financial fraud insurance and monitoring for identity theft or fraud and unauthorized transactions.
To file a BMS CAT settlement claim form online, class members can head to this page and log in using the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.
All BMS CAT settlement claim forms must be submitted online or by mail by July 8, 2026.
The court will determine whether to grant final approval to the BMS CAT data breach settlement following a hearing on July 23, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The BMS CAT class action lawsuit claimed that the disaster damage restoration and reconstruction firm failed to have in place reasonable cybersecurity measures to protect the sensitive information of current and former employees, which allegedly led to a data breach between February 5, 2025 and February 24, 2025.
Per court documents, private information that may have been compromised during the breach included names and Social Security numbers.
