A $757K ESO Solutions settlement offers cash to individuals whose information may have been compromised during a Sept. 2023 data breach.
ESO Solutions has agreed to a $757,500 settlement to wrap up a class action lawsuit alleging the emergency response software developer failed to protect sensitive consumer information from a September 2023 cyberattack.

The ESO Solutions class action settlement received preliminary approval from the court on November 24, 2025 and covers approximately 49,472 individuals who received a notice letter from ESO and resided in Texas at the time the company distributed letters about the September 2023 data breach.

According to the website, ESO Solutions settlement class members who submit a timely, valid claim form have multiple options for reimbursement. Consumers who submit with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $5,000. The settlement site adds that covered losses must have been reasonably incurred on or after September 28, 2023, as a result of the ESO data breach, and reimbursable expenses include costs related to credit monitoring, fraud, obtaining credit reports, and freezing credit.
In lieu of a documented-loss payment, class members may instead file a claim form to receive a one-time, pro-rated cash payment, the settlement website says. The settlement agreement relays that the amount each class member may receive will be based on the total number of valid claims filed and how much remains in the net settlement fund after the payment of attorneys’ fees, settlement administration costs, service awards and documented-loss payments.
Per the settlement agreement, ESO class members may elect to receive their payout via check or electronic payment, and all checks must be cashed within 90 days of issuance before expiration.
Finally, as part of the settlement, ESO has also agreed to implement certain business practice changes designed to improve its data security and safeguard sensitive information to prevent future data breaches.
To submit an ESO data breach settlement claim form online, class members can head to this page and enter the class member ID provided on their copy of the settlement notice. Consumers who believe they may be an ESO Solutions class member but did not receive a settlement notice should contact the settlement administrator to confirm their identity and receive their login information.
Alternatively, class members may download a PDF of the claim form from the ESO settlement website to print, fill out and return by mail to the address listed near the top of the document.
All ESO settlement claim forms must be submitted online or by mail by March 12, 2026.
The court will determine whether to grant final approval to the ESO Solutions data breach settlement at a hearing on April 16, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The ESO Solutions class action lawsuit alleged that the EMS software services provider failed to implement proper cybersecurity measures to safeguard private consumer information stored on its systems, leading to a data breach on or around September 28, 2023. Per court documents, the private data compromised as a result of the data breach included, but was not limited to, names, contact information, addresses, Social Security numbers, medical records, insurance information, payment information and medical treatment history.
