$750K VisionPoint Eye Center Settlement Ends Class Action Lawsuit Over October 2024 Data Breach

VisionPoint Eye Center has agreed to pay up to $750,000 to settle a class action lawsuit that claimed the Illinois-based optometry practice failed to properly protect sensitive patient information from a targeted cyberattack in October 2024.

The VisionPoint Eye Center settlement received preliminary approval from the court on November 3, 2025 and covers approximately 66,924 individuals whose personal information was compromised as a result of the October 2024 data breach, including those who received notice about the incident.

According to the website, VisionPoint settlement class members who submit a valid, timely claim form have multiple options for reimbursement. Consumers who provide with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $2,500. Per the settlement agreement, reimbursable expenses must have been incurred as a result of the October 2024 data breach and include costs related to credit reports, credit freezes, card replacement, late fees, bank fees, and identity theft insurance.
In lieu of a documented-loss payment, class members may instead file a claim form to receive a one-time, pro-rated alternative cash payout estimated to be $45. The settlement website notes that the total payout amount each class member may be eligible to receive may change depending on the total number of valid claims filed and how much remains in the net settlement fund after the payment of attorneys’ fees, lead plaintiff service awards, settlement administration costs and documented-loss payments.
All VisionPoint class members can elect to receive their payout via check or electronic payment, and all checks must be cashed within 90 days after issuance before expiration.
In addition to either cash payout option, all settlement class members are also eligible to enroll in two free years of one-bureau credit monitoring services. According to the settlement agreement, activation codes will be sent via email to class members with valid claim forms, and codes must be activated within 180 days after issuance before expiration.
To submit a VisionPoint settlement claim form online, class members can head to this page and enter the unique class member ID and PIN found on their copy of the settlement notice. Consumers who believe they may be a VisionPoint settlement class member but did not receive a notice should contact the settlement administrator to confirm their identity and receive their login credentials.
Alternatively, class members can download a PDF of the claim form from the settlement website to print, fill out and return by mail to the address listed near the top of the document.
All VisionPoint settlement claim forms must be submitted online or by mail by March 3, 2026.
The court will determine whether to grant final approval to the VisionPoint data breach settlement at a hearing on March 2, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The VisionPoint Eye Center class action lawsuit alleged that the healthcare provider failed to implement proper security measures to safeguard the sensitive consumer information stored on its systems, allegedly in violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, which led to a data breach on or around October 3, 2024.
