Chimienti & Associates has agreed to a $650,000 class action settlement to resolve a lawsuit that alleged the managing general agency and insurance services firm failed to safeguard confidential information from a March 2024 data breach.

The Chimienti & Associates class action settlement received preliminary approval from the court on June 4, 2026. Eligible for the settlement are all living United States residents whose private information was impacted in the Chimienti & Associates data breach.

Chimienti & Associates class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred between March 22, 2024 and December 28, 2026 due to the data breach. This benefit covers losses from identity theft or fraud and costs for credit reports, credit monitoring, freezing/unfreezing credit, replacement IDs, postage and more.
Class members must submit proof, such as receipts, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can file a claim form to receive a pro rata (proportional) cash payment of up to $100, with no proof required. The final amount of this cash payout will be determined based on the number of valid claims filed, among other factors.
Lastly, all class members can submit a claim form to enroll in two years of CyEx Financial Shield Complete, which includes one-bureau credit monitoring and financial fraud insurance.
To submit a Chimienti & Associates settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Chimienti & Associates settlement claim forms must be submitted online or postmarked by December 28, 2026.
The court will determine whether to grant final approval to the Chimienti & Associates data breach settlement following a hearing on January 12, 2027. Benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Chimienti & Associates class action lawsuit alleged that the California-based company, which provides voluntary and employer-paid benefits solutions, failed to implement adequate cybersecurity measures to protect sensitive information from a targeted cyberattack that occurred between March 22 and March 26, 2024.
Court documents state that private information that may have been compromised during the data breach included names, Social Security numbers, dates of birth, state-issued IDs, financial account information and health information.
