Settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred due to the data breach. This benefit covers losses from identity theft, fraud or other misuse; credit monitoring costs; costs of professional services, such as credit repair services; and other expenses such as postage, long-distance phone charges, mileage and more.
As part of this benefit, class members can also receive reimbursement for up to 10 hours of lost time spent remedying fraud, identity theft or misuse of their personal information because of the data breach, at a rate of $25 per hour.
Class members must submit proof, such as receipts, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can file a claim form to receive an estimated $50 cash payment.
The final amount of each class member’s documented-loss or alternative cash payment may be increased or decreased on a pro rata (proportional) basis, depending on the total number of valid claims filed, among other factors.
Lastly, class members can elect on their claim form to enroll in up to two years of CyEx Medical Shield Pro, which includes monitoring of medical and healthcare information.
To submit an American Medical Collection Agency settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All American Medical Collection Agency settlement claim forms must be submitted online or postmarked by January 4, 2027.
The court will determine whether to grant final approval to the American Medical Collection Agency data breach settlement following a hearing on January 7, 2027. Settlement benefits will begin to be made available to class members only after final approval has been granted and any appeals have been resolved.
The American Medical Collection Agency class action lawsuit alleged that Sonic Healthcare, Aurora Diagnostics, Clinical Pathology Laboratories and Austin Pathology Associates failed to protect sensitive information from a data breach that occurred between August 1, 2018 and March 30, 2019 at AMCA, which contracted with the defendants to collect outstanding medical debt from patients.
In April 2026, a $35 million settlement with Labcorp received preliminary approval from the court, resolving claims in a class action lawsuit filed against the company and others over the same American Medical Collection Agency data breach.
