A $527K Ambulatory Surgery Center settlement wraps up a class action lawsuit over a 2023 data breach.
Mount Kisco Surgery Center LLC, which does business as The Ambulatory Surgery Center of Westchester, has agreed to a $527,500 settlement to resolve a class action lawsuit that alleged the outpatient facility failed to protect the sensitive information in its care from a data breach reportedly discovered in November 2023.

The $527,500 Ambulatory Surgery Center of Westchester class action settlement received preliminary approval from the court on March 24, 2026. The deal covers all individuals in the United States whose private information was potentially impacted as a result of the data breach.

According to the website, Ambulatory Surgery Center settlement class members who file a valid, timely claim form can receive up to $5,000 for documented losses incurred between November 3, 2023 and June 29, 2026 due to the data breach. This benefit covers out-of-pocket losses related to identity theft or fraud and costs for credit reports, credit monitoring services, freezing or unfreezing credit, replacement IDs, and miscellaneous expenses, such as postage.
Class members must submit proof, such as receipts or bank statements, to receive a documented-loss payment.
In lieu of a documented-loss payment, class members can instead file a claim form for a roughly $100 cash payment, with no proof required. The final amount of this cash payout may increase or decrease, depending on the total number of valid claims filed.
In addition to monetary benefits, all class members can also file a claim form to receive two years of one-bureau credit monitoring.
Finally, the Ambulatory Surgery Center has agreed to enhance its data security systems and environment in response to the data breach.
To file an Ambulatory Surgery Center of Westchester settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.
All Ambulatory Surgery Center of Westchester settlement claim forms must be submitted online or by mail by June 29, 2026.
The court will determine whether to grant final approval to the Ambulatory Surgery Center of Westchester data breach settlement following a hearing on September 9, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Ambulatory Surgery Center of Westchester class action lawsuit alleged that the medical center in Mount Kisco, New York, failed to implement reasonable cybersecurity measures to protect sensitive information on its systems, which led to a data breach discovered by the practice on November 3, 2023.
Per court documents, private information that may have been exposed during the breach included names, Social Security numbers, driver’s license and state identification numbers, dates of birth, medical information, health insurance information and financial account information.
