The New York Blood Center class action settlement received preliminary approval from the court on October 14, 2025, and covers all United States residents who received notice that their data may have been compromised in the January 2025 data breach. According to court documents, approximately 18,487 current or former living employees and approximately 175,335 living donors were sent notice of the data incident from the blood center.

According to the settlement website, New York Blood Center settlement class members who submit a timely, valid claim form have multiple options for reimbursement.
Those who submit with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $2,500, referred to in settlement documents as “Cash Payment A”. This documentation, the agreement stipulates, must demonstrate that the expenses resulted from fraud, identity theft, or other misuse of personal information stemming from the data breach and that the class member made reasonable efforts to avoid the losses or obtain reimbursement.
In place of a documented loss payment, class members may instead file a claim one-time payment of approximately $20, also referred to as “Cash Payment B”. The final amount of this cash payout, the agreement outlines, is subject to a pro rata (equal share) increase or decrease depending on what remains in the net settlement fund after the payment of attorneys’ fees, settlement administration costs, lead plaintiff service awards, and the payment of all other benefits.
In addition to monetary reimbursement, class members can receive up to two free years of CyEx Medical Shield Pro, which includes services such as identity theft insurance, health insurance ID monitoring, and medical record monitoring.
Finally, as part of the settlement, the New York Blood Center has agreed to implement enhanced cybersecurity measures designed to mitigate the risk of future data security incidents.
To submit a New York Blood Center settlement claim form, class members can visit this page of the settlement site and enter the unique ID and PIN as found on their copy of the settlement notice. Class members who prefer a paper copy can also download a PDF of the claim form here to print, fill out, and return by mail to the address of the settlement administrator.
All New York Blood Center settlement claim forms must be submitted online or postmarked by February 11, 2026.
The court will determine whether to grant final approval to the New York Blood Center settlement at a hearing on February 10, 2026. Compensation will begin to be distributed only after final approval is granted and any appeals are resolved.
The New York Blood Center class action lawsuit claimed that the blood donation and testing company did not implement adequate cybersecurity measures to protect sensitive employee and donor information stored on its network, which also included the data of those tied to Memorial Blood Center, leading to a January 2025 data breach.
