The Illinois Bone and Joint Institute, LLC has agreed to a $4,000,000 settlement to resolve a class action lawsuit that alleged the orthopedic group failed to protect sensitive information stored on its systems from a data breach discovered in July 2024.

The $4 million Illinois Bone and Joint Institute class action settlement received preliminary approval from the court on March 3, 2026. The deal covers all United States residents who received a notice stating that their personal information was potentially compromised in the data breach discovered by Illinois Bone and Joint Institute in July 2024, including anyone who received notice of the incident.
Court documents state that approximately 568,000 people are covered by the class action settlement.
The court-approved website for the Illinois Bone and Joint Institute (IBJI) data breach settlement can be found at IBJISettlement.com.
According to the website, IBJI settlement class members who file a valid, timely claim form can receive up to $5,000 for documented out-of-pocket losses stemming from the data breach.
The settlement agreement relays that this benefit covers losses related to identity theft and fraud; costs incurred after May 30, 2024 to obtain credit monitoring, identity theft protection services, credit reports, and to freeze and/or unfreeze credit; and other miscellaneous expenses.
Proof, such as receipts or bank statements, is required to receive an out-of-pocket loss payment.
In addition to or instead of an out-of-pocket loss payment, class members can file a claim form to receive a cash payment of approximately $50, with no proof required.
The agreement notes that the value of this cash payout may increase or decrease, depending on the total number of class members who claim this benefit.
In addition to monetary benefits, all class members can submit a claim to receive an activation code for two years of Kroll Medical Monitoring, which includes one-bureau credit monitoring, dark web scanning, medical identity monitoring, identity theft restoration and other protection services.

All Illinois Bone and Joint Institute settlement claim forms must be submitted online or by mail by July 1, 2026.
Finally, as part of the settlement, IBJI has made certain changes to its information security system in response to the data breach.
The court will determine whether to grant final approval to the Illinois Bone and Joint Institute data breach settlement following a hearing on July 1, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Illinois Bone and Joint Institute class action lawsuit claimed that the Chicago-based orthopedic practice failed to implement reasonable cybersecurity measures to protect the private information stored on its systems, which led to a data breach discovered on or around July 4, 2024.
