$1.45M OrthopedicsNY Settlement Ends Class Action Lawsuit Over December 2023 Data Breach

A $1.45M OrthopedicsNY settlement offers cash to those whose personal information may have been impacted by a December 2023 data breach.
OrthopedicsNY has agreed to a $1,450,000 class action settlement to resolve a lawsuit that alleged the orthopedic healthcare provider failed to protect sensitive patient and employee information from a late-December 2023 data breach.

The $1.45 million OrthopedicsNY class action settlement received preliminary court approval on February 25, 2026. The deal covers all United States residents who were sent a notice from the orthopedic medical practice that their private information may have been impacted in the data breach.
The court-approved website for the OrthopedicsNY data breach settlement can be found at NYOrthoSettlement.com.
According to the settlement agreement, class members who submit a timely, valid claim form can receive up to $2,500 in reimbursement for out-of-pocket losses arising from the data breach, including losses related to fraud or identity theft and expenses for credit reports and credit monitoring.
The agreement states that class members must submit reasonable third-party documentation, such as invoices, bank statements, or receipts, to receive a documented-loss payment.
In lieu of a claim for documented losses, class members may instead submit a claim form, with no proof required, to receive an alternative cash payout of $50, the settlement website says.
Court documents note that the amount of the cash payment each class member may receive will depend on the total number of valid claims filed.
To submit an OrthopedicsNY data breach settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All OrthopedicsNY settlement claim forms must be submitted online or postmarked no later than June 15, 2026.
The court will determine whether to grant the OrthopedicsNY settlement final approval following a hearing on June 30, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The OrthopedicsNY class action lawsuit alleged that the New York-based orthopedic medical practice failed to implement reasonable cybersecurity measures to protect current and former patients’ and employees’ private information, leading to a data breach on or around December 28, 2023. According to the filing, sensitive information that may have been extracted during the breach included patient names, dates of birth, passport and driver’s license numbers, Social Security numbers, addresses, financial account information and protected health information.
