$400K Choose Your Horizon Settlement Ends Class Action Lawsuit Over Alleged Third-Party Data Sharing

Choose Your Horizon has agreed to a $400,000 settlement to resolve a class action lawsuit that claimed the at-home ketamine therapy provider implemented third-party tracking software on its websites that collected and disseminated patients’ confidential medical information to third parties.

The Choose Your Horizon class action settlement received preliminary approval from the court on January 29, 2026 and covers all California residents who, between May 9, 2023 and July 11, 2024, had their personally identifiable information or protected health information shared with third parties as a result of visiting ChooseYourHorizon.com and/or ChooseKetamine.com while in California.
Court documents indicate that there are approximately 761 individuals in the settlement class.
The court-approved website for the Choose Your Horizon (CYH) settlement can be found at CYHSettlement.com.
According to the website, CYH settlement class members who previously received a copy of the settlement notice do not need to do anything to automatically receive a one-time, pro-rated cash payment from the settlement fund after the payment of attorneys’ fees, litigation costs, lead plaintiff service awards and administrative expenses.
Per the preliminary approval order, the class counsel estimates that the final amount of this cash payout will be $337 per class member. This payment will be automatically issued to class members by the settlement administrator via check to their last known address on file.
CYH settlement class members who received a notice and wish to update their address or select their preferred form of payment (including PayPal or Venmo) can head to this page and log in to the Address Update/Payment Selection Form using the unique ID and PIN found on their received copy of the settlement notice.
Consumers who did not receive a settlement notice but believe they may be a CYH class member may still receive compensation from the settlement by filing a timely, valid claim form.
To receive this one-time, pro-rated cash payment, class members can file an online claim on this page by filling in all fields with their relevant information. Alternatively, class members can download a PDF of the claim form from the settlement site to print, fill out and return by mail to the settlement administrator at the address near the bottom of the document.
All CYH settlement claim forms must be submitted online or by mail by April 23, 2026.
Class members who received notice of the settlement but want to request exclusion from the deal may retain all legal rights by filling out the exclusion form on the settlement site, using the unique ID and PIN found on their copy of the notice. All exclusion requests must be submitted no later than March 24, 2026.
The court will determine whether to grant final approval to the CYH settlement following a hearing on April 23, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Choose Your Horizon class action lawsuit alleged that the telehealth ketamine therapy provider, which treats anxiety, depression, PTSD and alcohol use disorder, embedded tracking software on its website, including trackers made by Meta and Google, that disclosed sensitive patient data to third parties for the purpose of targeted advertising.
