$4.85M Bayer Settlement Ends Class Action Lawsuit Over Alleged Benzene Contamination in Anti-Fungal Sprays

A class action claims certain Lotrimin and Tinactin anti-fungal sprays have been contaminated with “dangerously high” levels of benzene, a known carcinogen.
Bayer has agreed to a $4,850,000 settlement to resolve a class action lawsuit that alleged certain Lotrimin and Tinactin anti-fungal sprays manufactured by the pharmaceutical giant were contaminated with high levels of benzene, a known carcinogen.

The Bayer anti-fungal spray settlement received preliminary approval from the court on December 11, 2025 and covers all consumers who purchased, after November 16, 2015, any of the following Bayer products that were subject to Bayer’s October 2021 recall (which included products purchased from September 2018 to October 2021):
- Lotrimin Anti-Fungal (AF) Athlete’s Foot Powder Spray;
- Lotrimin Anti-Fungal Jock Itch (AFJI) Athlete’s Foot Powder Spray;
- Lotrimin Anti-Fungal (AF) Athlete’s Foot Deodorant Powder Spray;
- Lotrimin AF Athlete’s Foot Liquid Spray;
- Lotrimin AF Athlete’s Foot Daily Prevention Deodorant Powder Spray;
- Tinactin Jock Itch (JI) Powder Spray;
- Tinactin Athlete’s Foot Deodorant Powder Spray;
- Tinactin Athlete’s Foot Powder Spray; and
- Tinactin Athlete’s Foot Liquid Spray.

To submit a Bayer settlement claim form online, settlement class members can head to this page and select whether or not they have documented proof of Bayer product purchases. From there, class members will be asked to complete all applicable fields with relevant information in order to receive their payout.
Alternatively, class members can download a PDF claim form from the settlement site to print, fill out, and return by mail to the address of the settlement administrator provided near the top of the document.
All Bayer anti-fungal spray claim forms must be submitted online or by mail by March 11, 2026, and only one claim can be submitted per household.
According to the settlement website, class members who submit a timely, valid claim form have multiple options for reimbursement.
Those who submit with their claim form documented proof of purchase of a listed Bayer spray are eligible to receive a one-time cash payment in the full amount of the product’s purchase price, excluding any sales tax. Per the settlement agreement, there is no limit to the number of products a class member can receive a refund for under this reimbursement option, provided that the applicable documentation is present and valid.
In lieu of a documented-purchase payment, Bayer class members may instead file a claim to receive a one-time cash payment as reimbursement for up to three units purchased per household at a rate of $7 per unit, for a maximum of $21. These payments, the agreement explains, may become pro-rated depending on the total number of valid claims filed and what remains in the net settlement fund after the payment of attorneys’ fees, settlement administration costs, lead plaintiff service awards, and all proof-of-purchase reimbursements.
Importantly, the agreement specifies that any cash payouts will be reduced by the number of payments a class member’s household has already received from the October 2021 Bayer recall program.
For instance, the agreement stipulates, if a class member already received a recall payout for two Bayer products and attempts to file a claim for the same two products under this settlement, no payment will be made to this class member, effectively preventing any “double-dipping” of benefits.
The settlement agreement adds that a class member who has already received three recall program payments but purchased additional Bayer products during the class period may file a claim to receive up to one additional no proof-of-purchase payment per household.
Class members may elect to receive their payout via check or electronic payment upon filing a claim, the agreement informs, and all checks must be cashed within 180 days of issuance.
Consumers who have difficulty completing their claim form, or who have any other questions about the settlement, may contact the settlement administrator to receive more information.
The court will determine whether to grant final approval to the Bayer anti-fungal spray class action settlement at a hearing on May 13, 2026. Compensation will begin to be distributed to consumers only after final approval is granted and any appeals are resolved.
The Bayer anti-fungal spray class action lawsuit claimed that several types of the company’s Lotrimin and Tinactin anti-fungal sprays were contaminated with benzene, a known carcinogen. The case was filed after the Bayer products were voluntarily recalled in October 2021 and claimed that although refunds were offered, the recall did not go far enough to truly compensate consumers considering the grave implications of benzene contamination, which has been linked to leukemia and other cancers.
