The Erickson Companies class action settlement received preliminary approval from the court on November 12, 2025 and covers approximately 11,820 individuals whose personal information may have been compromised during the data breach, including those who received notice of the data incident from Erickson in August 2025.
The court-approved website for the Erickson Companies data breach settlement can be found at EricksonSettlement.com.
According to the website, Erickson settlement class members who submit a timely, valid claim form are eligible to choose between two forms of cash payment. Those who submit with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $5,000, referred to as “Cash Payment A” on all court documents.
Per the settlement agreement, reimbursable expenses must have been incurred as a result of the November 2024 data breach, and claims for expenses must be supported by reasonable documentation, such as invoices or receipts.
In lieu of, or in addition to a documented-loss payment, Erickson settlement class members may also file a claim to receive a one-time, pro-rated cash payment of approximately $95, also referred to as “Cash Payment B” on all court documents. The actual amount each class member receives, the settlement agreement outlines, may increase or decrease depending on what remains in the net settlement fund after the payment of attorneys’ fees, lead plaintiff service awards, settlement administration costs, and the cost of all other benefits.
To submit a claim form online, class members can go to this page and enter the unique ID and PIN from their copy of the settlement notice. Class members who prefer a paper copy can download a PDF of the claim form, complete it, and return it by mail to the address of the settlement administrator.
All Erickson Companies settlement claim forms must be submitted online or postmarked by February 10, 2026.
Notably, the settlement agreement further stipulates that Erickson Companies “either have undertaken or will undertake reasonable steps to further secure their systems and environments” from future data breaches. This includes business practice changes including the implementation of virtual private networks (VPNs), multi-factor authentication, and enhanced email scanning and filtering, the agreement details.
The court will determine whether to grant final approval to the Erickson Companies class action settlement at a hearing on March 12, 2026. Compensation will begin to be distributed only after final approval is granted and any appeals are resolved.
The Erickson Companies data breach class action lawsuit alleged that the construction company negligently failed to protect consumers’ private information from unauthorized third parties and on or about November 18, 2024, Erickson Companies became aware of a data breach that potentially exposed private information including names, addresses, driver’s license numbers, and Social Security numbers of approximately 11,820 people.
