According to the website, Simpson settlement class members who submit a valid, timely claim form have multiple options for reimbursement. Those who submit with their claim form documented proof of ordinary losses are eligible to receive a one-time cash payment of up to $500. The settlement agreement outlines that reimbursable ordinary losses must have been incurred as a result of the October 2023 data breach and include costs related to bank fees, costs to obtain credit reports, credit monitoring services, identity theft and fraud.
Moreover, settlement class members may file a claim form for monetary reimbursement of lost time spent remedying issues related to the data breach, at a rate of $20 per hour, for a maximum of four hours.
Class members who submit with their claim form documented proof of extraordinary losses are eligible to receive a one-time cash payment of up to $5,000, the settlement website continues. Simpson Strong-Tie settlement class members may elect to receive their payout via check or electronic payment and all checks must be cashed within 90 days after issuance before expiration.
In addition to any monetary reimbursement, all class members, including those who have already received other identity theft protection and/or credit monitoring services from Simpson, are also eligible to enroll in two free years of identity theft protection and credit monitoring. Per the settlement agreement, activation codes for this benefit will be issued to class members via email, and must also be used within 90 days after issuance before expiration.
Finally, as part of the settlement, Simpson Strong-Tie has agreed to certain business practice changes to enhance its data security measures to mitigate future data breaches.
