The Costa Del Mar class action settlement received preliminary approval from the court on September 22, 2026. Eligible for the settlement are all citizens of Florida who:
- Purchased non-prescription, non-promotional Costa sunglasses for personal use between July 28, 2013 and January 31, 2018 (the “purchase class”); and/or
- Purchased non-prescription, non-promotional Costa sunglasses for personal use on or before January 31, 2018 and were charged a fee by Costa between July 28, 2012 and January 26, 2025 to replace damaged components of their non-prescription, non-promotional Costa sunglasses (the “repair class”).
The court-authorized Costa Del Mar class action settlement website can be found at CostaSunglassLitigation.com.
Settlement class members in the repair class do not need to file a claim form to automatically receive a pro rata (equal share) cash payment for each eligible repair that cost more than $11.95.
Class members in the purchase class can file a timely, valid claim form to receive a pro rata cash payment for each eligible purchase of Costa sunglasses. Class members who submit a claim form for more than five eligible Costa purchases may be required to submit supporting documentation.
If an individual is in both the purchase and repair classes, they can only participate in the settlement as a repair class member.
Court documents state that $6,375,000 of the settlement fund will be allocated for the purchase class, with the remainder of the fund allocated for the repair class after the deduction of settlement administration costs and attorney fees and expenses.
To file a Costa Del Mar settlement claim form online, class members can head to this page and enter their information, including the unique ID and PIN found on their copy of the settlement notice, if available. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Costa Del Mar settlement claim forms must be submitted online or postmarked by January 11, 2027.
The court will determine whether to grant final approval to the Costa Del Mar class action settlement following a hearing on March 23, 2027. Settlement money will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Costa Del Mar class action lawsuit alleged that the sunglasses manufacturer represented that consumers could obtain a repair for sunglasses damaged by accident, normal wear and tear, or misuse for a “nominal” fee, only to then charge substantially more than a nominal amount for the repair, in violation of the federal Magnuson-Moss Warranty Act and Florida’s Deceptive and Unfair Trade Practices Act.
In July 2026, a separate $23.9 million settlement with Costa Del Mar received preliminary approval from the United States District Court for the Middle District of Florida, resolving a class action lawsuit against the company over similar allegations.
