$20M VSL Pharmaceuticals Settlement Resolves Class Action Lawsuit Over Alleged VSL#3 Reformulation

VSL Pharmaceuticals, Inc., Leadiant Biosciences, Inc. and Alfasigma USA, Inc. have agreed to a $20 million settlement to resolve a class action lawsuit that alleged the pharmaceutical companies misleadingly sold a cheaper, less effective VSL#3 formula while claiming that the probiotic was made with its original formula.

The VSL Pharmaceuticals class action settlement received preliminary approval from the court on July 8, 2026. Eligible to participate in the settlement are all individuals who purchased VSL#3 in the United States between June 1, 2016 and June 19, 2019.

Settlement class members who submit a timely, valid claim form can receive $20 per unit of VSL#3 they purchased. For settlement purposes, a “unit” is defined as a bottle or box of VSL#3, with each bottle in a multipack counting as a unit.

Class members who do not have proof of purchase can submit a claim for one unit of VSL#3 purchased per household, while class members with proof of purchase can file a claim for three units of VSL#3, or the total number of units for which they submit proof of purchase, whichever is greater.

Class members with proof of purchase can claim up to 40 units of VSL#3, or $800.

The final amount of each class member’s cash payout may be increased or decreased on a pro rata basis, depending on the total number of valid claims filed, among other factors.

To submit a VSL Pharmaceuticals settlement claim form online, class members can head to this page and select whether they have the notice ID and confirmation code found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All VSL#3 settlement claim forms must be submitted online or postmarked by October 20, 2026.

The court will determine whether to grant final approval to the VSL Pharmaceuticals settlement following a hearing on January 6, 2027. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The VSL class action lawsuit alleged that the pharmaceutical companies, which sell VSL#3, a high-potency probiotic medical food designed for dietary management of certain gastrointestinal conditions, deceptively reformulated the supplement with less effective ingredients while continuing to represent that it contained the original formula.

The suit further claimed that the defendants deceptively cited clinical studies about the original formula in advertising and marketing materials, despite the reformulation.
