According to the settlement agreement, Onsite Mammography settlement class members who file a timely, valid claim form can receive up to $5,000 for out-of-pocket losses stemming from the data breach. Class members must provide documentation, such as receipts or bank statements, to receive this settlement benefit.
Per the settlement agreement, out-of-pocket loss payments cover costs related to freezing or unfreezing credit; obtaining credit reports and credit monitoring services; notary, fax, postage, copying, mileage and phone charges; and other mitigative expenses.
In addition to an out-of-pocket-loss payout, class members may file a claim form to receive a pro-rated cash payment, with no proof required. Cash payouts from the settlement may be increased or decreased depending upon the total number of valid claims filed, court documents state.
Finally, all class members can also file a claim form to receive an enrollment code for three years of three-bureau credit monitoring and identity theft insurance. The agreement notes that class members can still file a claim for this benefit even if they have already enrolled in previous credit monitoring services offered by Onsite Mammography in its data breach notice letter.
ClassAction.org will update this page with more information on how to file a class action settlement claim form as it is published by the settlement administrator.
The court will determine whether to grant final approval to the Onsite Mammography settlement following a hearing on September 9, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Onsite Mammography class action lawsuit claimed that the Massachusetts-based group of women’s healthcare providers failed to implement reasonable cybersecurity measures and protocols, which allegedly allowed cybercriminals to gain unauthorized access to the information of current and former patients by way of an employee’s email account in October 2024.
Per the lawsuit, private information that may have been exposed during the data breach included names, dates of birth, addresses, Social Security numbers, financial information, driver’s license and government-issued ID numbers, health information and other personally identifiable information.
