$2.25M Bank of America Settlement Ends Class Action Lawsuit Over Allegedly Excessive OON Fees

Bank of America, N.A. has agreed to a $2,250,000 settlement to resolve a class action lawsuit that alleged consumers were wrongfully charged multiple out-of-network (OON) fees on single balance inquiry requests made at certain ATMs located inside 7-Eleven stores.

The $2.25 million Bank of America class action settlement received preliminary approval from the court on March 12, 2026. The settlement covers all Bank of America accountholders in the United States who were assessed more than one OON balance inquiry fee during a visit to an ATM owned by FCTI, Inc. located inside a 7-Eleven store from May 1, 2018 to November 16, 2021.
The class action settlement deal excludes consumers who filed a claim in Weiss v. FCTI, Inc., a 2024 case over similar balance inquiry request fees at 7-Eleven ATMs operated by FCTI.

Bank of America settlement class members who are current accountholders and received notice of the settlement do not need to take any action to receive a pro rata cash payment from the deal.
Class members who are former accountholders and received notice must file a valid, timely claim form to receive a cash payment.
The final amount of each class member’s cash payout will depend on the total number of claims filed.
To file a Bank of America settlement claim form online, former accountholders can head to this page and log in using the class member ID found on their copy of the settlement notice. Alternatively, former Bank of America accountholders can download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.
All Bank of America settlement claim forms must be submitted online or by mail by June 29, 2026.
The court will determine whether to grant final approval to the Bank of America OON fee settlement following a hearing on August 21, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Bank of America class action lawsuit alleged that the nationwide financial institution breached its contracts with customers by assessing multiple out-of-network fees on single balance inquiry requests at 7-Eleven ATMs owned by FCTI, Inc.
