$4.5M Athena Bitcoin Settlement Ends Class Action Lawsuit Over Alleged Telemarketing Texts

Athena Bitcoin has agreed to a $4,500,000 settlement to resolve a class action lawsuit that alleged the Bitcoin ATM operator unlawfully sent promotional texts to consumers who previously requested to stop receiving the messages.

The $4.5 million Athena Bitcoin class action settlement received preliminary approval from the court on March 11, 2026 and covers:
- All individuals in the United States who, between August 20, 2020 and August 20, 2024, received more than one promotional text from Athena within any 12-month period, after more than 30 days had passed since they sent a “STOP” message request (the “Internal Do Not Call” class); and
- All Florida residents with telephone numbers that have a Florida area code who, between July 1, 2021 and August 20, 2024, received one or more promotional text messages from Athena after more than 15 days had passed since they sent a “STOP” message request (the “Florida Telephone Solicitation Act” class).
Court documents state that there are approximately 1,833 individuals in the Internal Do Not Call (IDNC) class, and approximately 639 individuals in the Florida Telephone Solicitation Act (FTSA) class.

According to the websites, Athena Bitcoin settlement class members who file a valid, timely claim form are eligible to receive a cash payment. The amount of each class member’s cash payout will be determined based on the number of messages they received and the total number of valid claims.
To file an Athena Bitcoin settlement claim form online, consumers can head to this page and log in using the class member ID found on their copy of the settlement notice.
Florida residents covered by the deal can file a claim form online on this page using the class member ID found on their copy of the FTSA settlement notice.
Alternatively, class members can download a PDF of the claim form to print, complete and return to the settlement administrator. Florida residents can download a PDF of the claim form here.
All Athena Bitcoin settlement claim forms must be submitted online or by mail by June 30, 2026.
Court documents stress that consumers must file a claim form for the class of which they are a member. Class members who file a claim form for the incorrect class, i.e., filing a Florida-specific claim form when they did not reside in the state during the relevant time period, may not receive compensation.
The court will determine whether to grant final approval to the Athena Bitcoin TCPA settlement following a hearing on August 10, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Athena Bitcoin class action lawsuit alleged that the nationwide Bitcoin ATM operator wrongfully sent promotional and marketing texts to the cell numbers of consumers who indicated that they wanted to stop or opt out of the messages, in violation of the Telephone Consumer Protection Act and Florida Telephone Solicitation Act.
