Rancho Mesquite Casino has agreed to pay $1,000,000 to resolve a class action lawsuit that alleged the Nevada resort, which operates as Eureka Casino Hotel, failed to protect sensitive consumer information stored on its systems from a November 2022 data breach.

The Eureka Casino Hotel class action settlement received preliminary approval from the court on January 8, 2026 and covers approximately 229,410 individuals residing in the United States whose private information was compromised in the November 2022 data breach, including all who received notice of the breach.

According to the website, Eureka settlement class members who file a valid, timely claim form have multiple options for reimbursement and may claim as many settlement benefits as they qualify for.
Class members who submit with their claim form documented proof of out-of-pocket losses stemming from the data breach are eligible to receive a one-time cash payment of up to $5,000 from the settlement.
According to the agreement, class members must submit supporting documentation prepared by a third party showing that their expenses were incurred between November 9, 2022 and May 11, 2026. All monetary losses must be traceable to the data breach, and reimbursable expenses include those related to identity theft, fraud, credit monitoring, bank fees, professional fees and any miscellaneous costs such as postage or mileage.
Eureka settlement class members may also file a claim to receive a one-time, pro-rated cash payment from the net settlement fund. The settlement agreement states that the final amount of this payment will depend on the total number of valid claims filed and on what remains in the settlement fund after payment of attorneys’ fees, administration costs, lead plaintiff service awards and all other settlement benefits.
Furthermore, all settlement class members residing in California, or who lived in California at any point between November 9, 2022 and May 11, 2026, may file a claim to receive a one-time $100 cash payment as stipulated by state-specific statutory laws. The agreement reports that if the number of claims filed for this benefit exceed the amount remaining in the settlement fund, California statutory payments may be subject to a pro-rated reduction.
Eureka class members may elect to receive their cash payouts via check or electronic payment, the agreement notes, and all checks must be cashed within 90 days of issuance before expiration.
To file an Eureka settlement claim form online, class members can head to this page and enter the notice ID and confirmation code found on their received copy of the settlement notice. Alternatively, class members may download a PDF of the claim form from the settlement site to print, fill out and return by mail to the address of the settlement administrator listed on the first page of the document.
All Eureka data breach claim forms must be submitted online or by mail by May 11, 2026.
Finally, as part of the settlement, Eureka has agreed to implement improved cybersecurity and data privacy protocols to mitigate the risk of any future data incidents.
The court will determine whether to grant final approval to the Eureka class action settlement following a hearing on June 10, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Eureka Casino Hotels class action lawsuit asserted that the casino resort failed to implement reasonable cybersecurity measures to protect the private information stored on its systems, resulting in a data breach sometime between November 9, 2022 and November 13, 2022. Per court documents, the personally identifiable information that may have been impacted by the breach included names, Social Security numbers, financial account information, passport numbers, and driver’s license or state-identification numbers.
