$17M Kroger Settlement Ends Lawsuit Over Allegedly Inflated Prescription Drug Prices

The Kroger Co. has agreed to a $17 million settlement to resolve a class action lawsuit that alleged the grocery store chain failed to take into account the prices it charged under its Savings Club when determining a prescription drug’s usual and customary price, causing insured consumers to pay inflated amounts for prescriptions.

The Kroger class action settlement received preliminary approval from the court on June 24, 2026. Eligible to participate in the settlement are all individuals in the United States and its territories who, at any point from December 9, 2018 through August 23, 2026, paid in whole or in part for one or more prescription drugs from Kroger (including The Kroger Co. and all pharmacies owned and/or operated by The Kroger Co. or any of its affiliates) using their insurance.

Settlement class members who file a timely, valid claim form can receive a pro rata cash payment based on the amount they paid for prescription medication from Kroger.

Class members who file a claim for $8,000 or more in reimbursement must submit supporting documentation, such as itemized receipts, invoices or statements, to receive a cash payment.   

Additionally, class members who have not been identified by Kroger as a purchaser of one or more prescription drugs will be contacted to submit supporting documentation to receive a cash payout, regardless of the claim amount. 

To submit a Kroger settlement claim form online, class members can head to this page and select whether they have the notice ID and confirmation code found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All Kroger settlement claim forms must be submitted online or postmarked by December 21, 2026.

The court will determine whether to grant final approval to the Kroger settlement following a hearing on January 11, 2027. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Kroger class action lawsuit alleged that the grocery store chain did not consider the prices it charged Savings Club members when determining the usual and customary prices of prescription medications, which inflated the price of prescriptions for consumers who paid for some or all of the cost of the drugs using insurance.
