$1.5M Krud Kutter Settlement Resolves Class Action Lawsuit Over ‘Non-Toxic,’ ‘Earth Friendly’ Advertising

A $1.5 million settlement has been reached to resolve a class action lawsuit that alleged Rust-Oleum Corporation falsely advertised certain Krud Kutter products as “Non-Toxic” and “Earth Friendly” given that the items may in fact cause harm to humans, animals and the environment.

The Krud Kutter class action settlement received preliminary approval from the court on April 17, 2025. The court-authorized website for the Krud Kutter settlement can be found at KrudKutterSettlement.com.
The deal covers all United States residents who, between May 13, 2016 and April 17, 2025, purchased any qualifying Krud Kutter product labeled “Non-Toxic” and “Earth Friendly” for personal or household use and not for resale, including:
- Krud Kutter Adhesive Remover;
- Krud Kutter Instant Carpet Stain Remover Plus Deodorizer;
- Krud Kutter Original Cleaner & Degreaser;
- Krud Kutter Tough Task Remover;
- Krud Kutter Sports Cleaner/Stain Remover;
- Krud Kutter Gutter & Exterior Metal Cleaner;
- Krud Kutter Kitchen Degreaser & All Purpose Cleaner;
- Krud Kutter Heavy Traffic Carpet Cleaner;
- Krud Kutter Deck & Fence Wash;
- Krud Kutter Multi-Purpose House Wash;
- Krud Kutter Window Wash;
- Krud Kutter Parts Washer Cleaner/Degreaser;
- Krud Kutter Driveway Cleaner & Degreaser;
- Krud Kutter Original Cleaner & Degreaser (aerosol); and
- Krud Kutter Tough Task Remover (aerosol).
Class members who submit a valid Krud Kutter claim form online or by mail by July 7, 2025 are eligible to receive a cash payout from the class action settlement.

According to the Krud Kutter settlement website, class members who file a timely, valid claim form may receive $1 per product purchased. Consumers who provide a receipt for their purchase or purchases are not subject to any cap on the number of products claimed, while those who submit a claim without proof of purchase are limited to eight items, the site shares.
Krud Kutter settlement payments may be adjusted on a pro rata basis as needed in order to exhaust the $1,500,000 fund, the website adds.
As part of the deal, Rust-Oleum Corporation has also agreed to remove the “Non-Toxic” representation from product packaging and add an asterisk to the front-label “Earth Friendly” claim that directs consumers to a qualifying statement on the back, the site relays.
The court will decide whether to grant final approval to the terms of the settlement agreement at a hearing on September 25, 2025.
Per the website, Krud Kutter settlement rebates will be issued to eligible class members only if the deal receives ultimate court approval, and after any appeals are resolved.
The Krud Kutter class action lawsuit alleged that consumers were misled by the false “Non-Toxic” and “Earth Friendly” representations and would not have paid as much, or purchased the products at all, had they known the items could adversely impact their health or the environment.
