$1.5M Akumin Settlement Resolves Class Action Lawsuit Over October 2023 Data Breach

The Akumin class action settlement received preliminary approval from the court on September 16, 2025 and covers any United States resident whose private information may have been impacted in the Akumin data breach.
Akumin who settlement class members submit a timely, valid claim form can receive a one-time cash payout of up to $2,500 via check or electronic payment, the class action settlement website details. In addition to the cash payment, settlement class members are also entitled to submit a claim for one free year of CyEx Medical Shield Complete medical data monitoring, which includes the monitoring of healthcare insurance plan IDs, medical records, health savings accounts and protection services, the settlement website shares.

Per the website, Akumin settlement claim forms must contain proof of documented losses incurred by the class member, in particular, documented, unreimbursed monetary losses due to fraud or identity theft that are traceable to the data incident.
To submit a settlement claim form online, Akumin class members can head to this page and enter the class member ID found in their copy of the settlement notice. Consumers who believe they are a class member but did not receive a notice should contact the settlement administrator to confirm their identity and receive their login ID.
Alternatively, a class member can download a PDF of the claim form to print, fill out, and return by mail to the address listed near the top of the form.
Akumin settlement claim forms must be submitted online or by mail by November 30, 2025.
The settlement website adds that class members who submit a valid claim will have 180 days to choose their form of payment.
The court will determine whether to grant final approval to the Akumin settlement at a hearing on December 15, 2025. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Akumin Operating Corp. class action lawsuit claimed that the October 2023 data breach resulted in patient monetary losses due to the unauthorized access to and/or acquisition of their private, personal information.
The patient information allegedly accessed during the Akumin data incident included, but was not limited to, names, home addresses, email addresses, dates of birth, Social Security numbers, driver’s license numbers, passport numbers, Medicare or Medicaid IDs, financial account details, payment card information, biometric information, medical histories, health insurance details, and more.
