Filed: January 8, 2024 ◆§ 3:24-cv-01062-RFL
A $1.2M GameSpot settlement ends a class action lawsuit over the alleged use of third-party trackers on its website.
Fandom has agreed to a $1.2M settlement to resolve a class action lawsuit alleging the media conglomerate surreptitiously installed trackers on GameSpot.com to collect, store, and transmit information from consumers’ web browsers without their knowledge or consent in violation of the California Invasion of Privacy Act (CIPA).

The Fandom class action settlement received preliminary court approval on December 16, 2025 and covers all individuals who accessed GameSpot.com or any of its subdomains in California and had their IP addresses collected by the trackers any time between January 5, 2023 and December 16, 2025.
The court-approved website for the GameSpot CIPA settlement can be found at GameSpotSettlement.com.
According to the website, GameSpot settlement class members who submit a timely, valid claim form with no proof required are eligible to receive a one-time, pro-rated cash payment from the net settlement fund after the payment of attorneys’ fees, lead plaintiff service awards and settlement administration costs.
Settlement documents state that if any checks are not cashed within 180 days, the cash will be redistributed on a pro-rated basis if each remaining settlement class member will receive at least $5. If any money from the settlement fund remains after a secondary payout, it will be distributed as a cy pres donation, the agreement adds.
To submit a GameSpot CIPA settlement claim form online, class members can head to this page and enter their contact information to generate a personalized claim form. Alternatively, class members can download a PDF claim form in English or Spanish to print, complete, and return by mail to the settlement administrator.
All GameSpot CIPA settlement claim forms must be submitted online or postmarked by April 16, 2026.
A hearing to determine whether the court will grant final approval to the GameSpot settlement will be held on May 19, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The GameSpot CIPA class action lawsuit claimed that Fandom, the operator and developer of the gaming site, installed third-party data trackers on the GameSpot website, including those from GumGum, Audiencerate, and Triplelift. According to the complaint, these trackers collected and conveyed consumers’ personal information for advertising purposes without their express consent, in violation of California’s Invasion of Privacy Act.
