$1.1M Knight Barry Title Class Action Settlement Ends Data Breach Lawsuit Over August 2023 Incident

A $1.1M Knight Barry Title settlement offers cash and credit monitoring to those who may have been impacted by an Aug. 2023 data incident.
Knight Barry Title has agreed to a $1,100,000 settlement to resolve a class action lawsuit that claimed the Wisconsin-based insurance company failed to protect sensitive consumer information stored on its systems from an August 2023 cyberattack.

The Knight Barry Title class action settlement received preliminary approval from the court on October 17, 2025 and covers approximately 44,910 individuals who were sent notice from Knight Barry of the August 2023 data breach.

According to the website, Knight Barry settlement class members who submit a valid, timely claim form have multiple options for reimbursement. Those who submit with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $5,000. The settlement agreement notes that reimbursable losses must have been incurred as a result of the Knight Barry data breach. Reimbursable data breach expenses include costs related to freezing credit, obtaining credit reports, bank fees, credit monitoring, and fraud, the settlement website says.
Knight Barry class members may also file a claim form, with no proof required, to receive a one-time, pro-rated cash payment. Per the settlement agreement, the amount each class member may receive depends on the total number of valid claims submitted and how much remains in the net settlement fund after the payment of attorneys’ fees, lead plaintiff service awards, settlement administration costs and the cost of all other settlement benefits.
All Knight Barry settlement class members can elect to receive their payout via check or electronic payment, and all checks must be cashed within 90 days after issuance before expiration.
In addition to monetary benefits, all class members are also eligible to submit a claim for three free years of identity theft protection and one-bureau credit monitoring. The settlement agreement notes that enrollment codes will be issued to class members via email or to their home address, and codes must be activated within 180 days after issuance before expiration.
Finally, as part of the settlement, Knight Barry has agreed to certain business practice changes to improve its data security measures and prevent future data breaches.
To submit a Knight Barry settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Consumers who believe they may be a Knight Barry settlement class member but did not receive a notice should contact the settlement administrator to confirm their identity and receive their login ID.
Alternatively, class members may download a PDF of the claim form from the settlement website to print, fill out and return by mail to the address listed near the top of the document.
All Knight Barry claim forms must be submitted online or by mail by February 17, 2026.
The court will determine whether to grant final approval to the Knight Barry settlement at a hearing on March 2, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Knight Barry Title class action lawsuit alleged that the insurance company failed to implement adequate cybersecurity measures to protect sensitive consumer information, leading to a targeted data breach on or around August 15, 2023.
