A $1.04M Kimco Staffing Services settlement offers cash and credit monitoring to individuals whose information was exposed in a 2023 data breach.

Kimco Staffing Services has agreed to a $1,040,000 class action settlement to resolve a lawsuit that alleged the workforce solutions company failed to adequately safeguard private information in its care from a June 2023 data breach.

The Kimco Staffing Services class action settlement received preliminary approval from the court on August 17, 2026. Eligible for the settlement are all United States residents whose personal information was exposed in the data incident involving Kimco Staffing, including all who were sent notice of the data breach.
Court documents state that the personally identifiable information of approximately 69,687 people was impacted in the cyberattack.

According to court documents, the Kimco Staffing Services settlement is comprised of a $640,000 cash fund and $400,000 in business practice enhancements to better secure personal information within its network.
Settlement class members who file a timely, valid claim form can receive up to $5,000 for documented out-of-pocket losses incurred between June 24, 2023 and December 15, 2026 due to the data breach. This benefit covers data breach-related costs for credit reports, credit monitoring, identity theft insurance, bank fees, long-distance phone charges, gasoline, and more.
Class members must submit proof, such as receipts, to receive a documented-loss payment.
In addition, class members who lived in California on June 24, 2023 can file a claim form to receive a $50 statutory cash payment.
Furthermore, class members can submit a claim form to receive a pro rata (equal share) cash payment from what remains of the $640,000 cash fund after the payment of all other settlement benefits and expenses. The final amount of each class member’s pro rata cash payout will be determined based on the total number of valid claims filed, among other factors.
Should the amount of money in the settlement fund be insufficient to cover documented-loss and California statutory payments, claims for such will be reduced on a pro rata basis to account for the amount that remains in the fund, and no money will be issued to class members in the form of a pro rata cash payment.
Lastly, class members who submit a claim form for any settlement benefit will automatically receive two years of credit monitoring and identity theft protection, which includes access to fraud resolution agents and identity theft insurance.
To file a Kimco Staffing Services settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Kimco Staffing Services settlement claim forms must be submitted online or postmarked by December 15, 2026.
The court will determine whether to grant final approval to the Kimco Staffing Services data breach settlement following a hearing on February 18, 2027. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Kimco Staffing Services class action lawsuit alleged that the California staffing agency failed to implement adequate cybersecurity measures to protect private information from a data breach on or around June 24, 2023.
Court documents state that personal information that may have been compromised during the data incident included names, Social Security numbers, financial account information, and payment card information.
