How Did We Get Here?
The Bath & Body Works and Victoria’s Secret lawsuit alleged that the retailers ran afoul of FACTA, a federal law that prohibits businesses from displaying more than the last five digits of a customer's payment card number or the card’s expiration date on any printed receipt at the point of sale.
According to the class action suit, the companies issued printed receipts that included the first six and last four digits of consumers’ payment card numbers, in violation of the federal law.
Enacted by Congress in 2003, FACTA was designed to protect consumers from identity theft and credit and debit card fraud. The complaint contended that the retailers, by issuing printed receipts in breach of FACTA requirements, jeopardized shoppers’ sensitive information and exposed them to serious privacy risks.
