Wayne Memorial Hospital Data Breach Settlement Resolves Lawsuit Over 2024 Cyber Incident

Wayne Memorial Hospital has signed on to a class action settlement offering cash and credit monitoring to resolve a lawsuit over a sizable mid-2024 data breach.

The Wayne Memorial Hospital class action settlement received preliminary approval from the court on August 19, 2026. Eligible to participate in the settlement are all individuals whose private information was accessible due to the Wayne Memorial Hospital data breach that occurred from roughly May 30 to June 3, 2024.

Court documents state that the cyber incident impacted the sensitive information of approximately 163,440 people.

The court-approved Wayne Memorial Hospital data breach settlement website can be found at WMHDataSettlement.com. 

Settlement class members who submit a timely, valid claim form can receive up to $5,000 in reimbursement for documented losses stemming from the data breach. This benefit covers losses from fraud and/or identity theft. 

Class members must submit proof, such as receipts or bank statements, to receive a documented-loss payment. 

In lieu of a documented-loss payout, class members can file a claim to receive an estimated $25 cash payment, with no proof required. The final amount of this payment may be reduced on a pro rata (equal-share) basis, depending on the total number of valid claims filed. 

Lastly, all class members are entitled to two years of one-bureau credit monitoring, which includes identity theft insurance. Settlement class members received credit-monitoring enrollment codes with their copy of the settlement notice.

To submit a Wayne Memorial Hospital settlement claim form online, class members can head to this page and enter the CPT ID and passcode found in their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator. 

Wayne Memorial Hospital claim forms must be filed online or by mail by December 7, 2026.

The court will decide whether to grant final approval to the Wayne Memorial Hospital data breach settlement following a hearing on January 27, 2027. Settlement benefits will become available after the deal has received final approval and any appeals are resolved. 

The class action lawsuit against Wayne Memorial Hospital Auxiliary, Inc., which operates as Wayne Memorial Hospital in Georgia, alleged that the healthcare organization failed to adequately protect the sensitive information in its care from unauthorized access between May 30 and June 3, 2024. According to court documents, the information impacted in the incident included names, dates of birth, Social Security numbers, patient account numbers, medical record numbers, treatment information and more.
