Valley Oaks Settlement Wraps Up Data Breach Lawsuit Over 2023 Cyber Incident

Valley Oaks Health has agreed to a class action settlement to resolve litigation over a June 2023 targeted cyberattack.
Valley Oaks Health, Inc. has agreed to a class action settlement offering cash and medical data monitoring to resolve litigation against the Indiana-based healthcare provider over a June 2023 targeted cyberattack.

The Valley Oaks class action settlement received preliminary approval from the court on August 10, 2026. Eligible to participate in the settlement are all individuals whose private information was potentially compromised as a result of the Valley Oaks data breach and who are included on the “settlement class list” the defendant is to provide to the settlement administrator.

Class members who submit a valid, timely claim form can receive up to $500 in reimbursement for “ordinary” out-of-pocket losses incurred between June 8, 2023 and November 9, 2026 due to the Valley Oaks data incident. This benefit covers costs for credit reports, credit monitoring, freezing or unfreezing credit, replacing IDs and more.
Class members can also submit a claim form to receive up to $5,000 for “extraordinary” out-of-pocket losses incurred during the same time period due to the cyberattack. This benefit covers losses from identity theft or fraud that are not already covered by the “ordinary” loss option.
Class members must submit proof, such as receipts, to receive an ordinary- and/or extraordinary-loss payout from the class action settlement.
In addition, class members can file a claim for reimbursement of up to four hours spent addressing the Valley Oaks data breach, at a rate of $20 per hour. This benefit covers activities such as changing passwords, investigating suspicious account activity and researching the cyber incident.
In lieu of any other monetary settlement benefit, class members can submit a claim form for a $40 cash payment, with no proof required.
Lastly, all class members can elect on their claim form to receive two years of CyEx Medical Shield Pro, which includes medical identity theft insurance and medical data monitoring.
To file a Valley Oaks settlement claim form online, class members can head to this page and enter the login ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Valley Oaks claim forms must be filed online or by mail by November 9, 2026.
The court will decide whether to grant final approval to the Valley Oaks data breach settlement following a hearing on December 10, 2026. Settlement money and other benefits will begin to be distributed after the deal receives final approval and any appeals are resolved.
The class action lawsuit against Valley Oaks Health alleged that the central Indiana-based healthcare provider, which specializes in mental health, addiction recovery and primary care, failed to adequately protect sensitive information on its systems from a targeted cyberattack in June 2023.
Per the lawsuit, information compromised in the Valley Oaks data incident included Social Security numbers, driver’s license numbers, state ID numbers, credit card/debit card numbers, biometric data, DNA profiles, usernames, email addresses, health information and more.
