Utz Lawsuit Alleges Boulder Canyon, Good Health ‘Avocado Oil’ Chips Made With Diluted Blend of Oils

A proposed class action lawsuit alleges that Utz Quality Foods has misled consumers into believing that its Boulder Canyon and Good Health “Avocado Oil” chips are made entirely with avocado oil.

The 27-page lawsuit claims that although Utz Quality Foods represents that its Boulder Canyon Avocado Oil Classic Sea Salt Kettle Style Potato Chips and Good Health Kettle Style 100% Avocado Oil Potato Chips, Sea Salt are made exclusively with avocado oil, independent testing has confirmed that the chips contain an undisclosed “diluted” blend of oils.

The class action complaint says that consumers value foods with avocado oil because the ingredient is widely recognized as a source of healthy dietary fats and valued for its nutritional profile and culinary qualities. As a result, consumers are willing to pay more for products that they reasonably believe contain avocado oil, the case states.

The lawsuit states that avocado oil possesses a distinctive fatty-acid and sterol composition that is a “reliable chemical fingerprint” used to distinguish it from other oils. The suit relays that researchers from the University of California Davis found in a 2026 peer-reviewed study that oil extracted from the Boulder Canyon and Good Health potato chips at issue did not have a chemical composition associated with genuine avocado oil and was instead consistent with avocado oil that was diluted or substituted with other oils.

Per the case, reasonable consumers would be unable to discern whether the chips exclusively contained avocado oil because the true nature of the potato chips’ oil ingredients is not disclosed in the ingredients lists. Moreover, consumers should not be expected to “scour” the products’ ingredients list to verify Utz’s claims that they contain avocado oil, the lawsuit adds.

The lawsuit accuses Utz of attempting to capitalize on consumers’ desire for foods that contain avocado oil, causing shoppers to pay more for the products than comparable potato chips that are not touted as containing avocado oil.

The Utz class action lawsuit looks to cover all consumers who purchased Boulder Canyon Avocado Oil Classic Sea Salt Kettle Style Potato Chips and/or Good Health Kettle Style 100% Avocado Oil Potato Chips, Sea Salt anywhere in the United States during the class period.
