Up to $30M High 5 Games Settlement Ends Lawsuit Over Gambling App Purchases

High 5 Games LLC and High 5 Entertainment LLC have agreed to pay up to $30 million to resolve a class action lawsuit that alleged the companies’ sale of virtual coins in the High 5 Casino and High 5 Vegas social casino apps violated Washington gambling law.

The High 5 Games class action settlement, which ranges from $12 million to $30 million, received preliminary approval from the court on August 14, 2026.

Eligible to participate in the settlement are all individuals in Washington who played or purchased virtual coins on either High 5 Casino or High 5 Vegas after April 9, 2014 and before October 1, 2022, including individuals reasonably determined by billing address information, IP address information, or other information furnished by Amazon, Apple, Facebook and/or Google to be located in Washington or associated with purchases in Washington.

High 5 settlement class members who submit a timely, valid claim form can receive a cash payment.

The final amount of each class member’s cash payout will depend on, among other factors, the total dollar amount of in-app purchases they made on High 5 Casino or High 5 Vegas after April 9, 2014 and before October 1, 2022, the total number of valid claims filed, and the total amount the defendants pay into the settlement fund during the multi-year payment period.

The settlement website states that, in “similar social casino litigation, Class Members have recovered substantial portions of the total amount they spent” in the apps at issue.

High 5 will pay into the settlement fund over a multi-year period, with an initial payment of $4 million and subsequent payments of at least $1 million each year for up to eight years, due to the defendants’ “financial situation.” High 5 may be required to make additional contingent payments depending on its annual net income and whether the company has a liquidity event.

Additional payments to class members may be issued during a multi-year period following the initial cash payout.  

To submit a High 5 Games settlement claim form online, class members can head to this page and enter the unique ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.

All High 5 settlement claim forms must be submitted online or postmarked by November 13, 2026.

The court will determine whether to grant final approval to the High 5 settlement following a hearing on December 14, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The High 5 Games class action lawsuit alleged that the sale of virtual coins in the High 5 Casino and High 5 Vegas social casino apps, as well as the defendants’ operation of the apps themselves, violated Washington’s Recovery of Money Lost at Gambling Act and the Washington Consumer Protection Act.
