Up to $3.6M BuyAlerts Settlement Ends TCPA Lawsuit Over Alleged Telemarketing Texts

A settlement of up to $3.6M ends a lawsuit that alleged BuyAlerts sent texts to consumers who opted out or whose numbers were on the National DNC registry.

Live Stream Technology Services, Inc., which does business as BuyAlerts, has agreed to a class action settlement worth up to $3.6 million to resolve a lawsuit that alleged the AI-powered financial and trading signals platform unlawfully sent telemarketing texts after consumers had requested to stop receiving the messages, and/or while their numbers were on the National Do-Not-Call Registry.

The BuyAlerts class action settlement received preliminary approval from the court on August 7, 2026. Eligible for the settlement are:
- All individuals in the United States who, from January 1, 2022 through August 7, 2026, were sent more than one text message regarding BuyAlerts’ goods or services sent by or on behalf of BuyAlerts within any 12-month period to their cell phone number after they communicated to BuyAlerts that they did not wish to receive text messages by replying to the messages with “stop” or a similar opt-out instruction;
- All individuals in Florida who, from January 1, 2022 through August 7, 2026, were sent more than one text message regarding BuyAlerts’ goods or services sent by or on behalf of BuyAlerts to their cell phone number after they texted BuyAlerts with the message “stop” at least 15 days prior to the text message; and
- All individuals in the United States who, from January 1, 2022 through August 7, 2026, were sent a text message sent by or on behalf of BuyAlerts more than once during any 12-month period regarding the sale of BuyAlerts’ goods or services where their phone number had been listed on the National Do-Not-Call Registry for at least 30 days and for whom BuyAlerts claims it did not obtain prior express written consent to send the messages, or obtained prior express written consent in the same manner as the company supposedly obtained prior consent to call the plaintiffs.

BuyAlerts settlement class members who file a timely, valid claim form can receive a cash payment of up to $42.16.
The final amount of each class member’s payment may be decreased on a pro rata (equal share) basis depending on the total number of valid claims filed, among other factors.
To submit a BuyAlerts settlement claim form online, class members can head to this page and enter the unique ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All BuyAlerts settlement claim forms must be filed online or postmarked by February 16, 2027.
The court will determine whether to grant final approval to the BuyAlerts class action settlement following a hearing on February 1, 2027. Settlement money will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The BuyAlerts class action lawsuit alleged that the Miami-headquartered fintech services company wrongfully sent consumers promotional marketing text messages after they had opted out of the solicitations, or while their phone numbers were listed on the National Do-Not-Call Registry and they had not provided consent to be contacted, in violation of the federal Telephone Consumer Protection Act and the Florida Telephone Solicitation Act.
