Up to $3.5M Evernorth MDLive Settlement Ends Lawsuit Over Alleged Disclosure of User Info

A settlement worth up to $3.5M ends a lawsuit that alleged Evernorth Health and MDLive disclosed website users’ info to third parties without consent.

Evernorth Health Inc. and MDLive, Inc. have agreed to a class action settlement worth up to $3.5 million to end a lawsuit that alleged the companies disclosed users’ sensitive information and private communications on the MDLive website to Google and Meta without consent.

The Evernorth MDLive class action settlement received preliminary approval from the court on August 28, 2026. Eligible for the settlement are all MDLive users who accessed MDLive’s portal, Patient.MDLive.com, and engaged in any activity on the portal after signing in from May 30, 2023 through August 11, 2025.
The court-approved Evernorth MDLive class action settlement website can be found at EHISettlement.com.
Evernorth MDLive settlement class members who file a timely, valid claim form can receive a cash payment of up to $15.
The final amount of each class member’s cash payout may be adjusted on a pro rata basis and will depend on the total number of valid claims filed, among other factors.
Class members must attest on their claim form that they are an MDLive user who accessed the MDLive portal from May 30, 2023 through August 11, 2025, engaged in any activity in the portal after signing in, and that they had an active Facebook and/or Google account during that period.
To file an Evernorth MDLive settlement claim form online, class members can head to this page and enter the claimant ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Evernorth MDLive settlement claim forms must be submitted online or postmarked by December 1, 2026.
The court will determine whether to grant final approval to the Evernorth MDLive class action settlement following a hearing on January 6, 2027. Settlement money will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Evernorth MDLive class action lawsuit alleged that the defendants deployed tracking technologies on the MDLive telehealth website that disclosed users’ sensitive information and private communications to Google and Meta without consent, in violation of the Electronic Communications Privacy Act and the Florida Security of Communications Act.
