Up to $15M DaVita Settlement Wraps Up Class Action Suit Over April 2025 Data Breach

Kidney dialysis provider DaVita has agreed to a class action settlement worth up to $15 million to end a lawsuit filed over an April 2025 data breach that impacted the sensitive information of roughly 2.4 million people.

The DaVita class action settlement received preliminary approval from the court on August 21, 2026. All individuals in the United States whose personal information was potentially accessed without authorization in the DaVita ransomware attack are eligible to participate in the settlement.

Class members who file a valid, timely claim form can receive up to $2,500 in reimbursement for documented out-of-pocket losses stemming from the DaVita data breach. This benefit covers losses from identity theft, fraud or other misuse of a class member’s information due to the cyber incident. 

Class members must submit proof, such as receipts, to receive a documented-loss payment. 

In addition, all class members can file a claim form to receive an estimated $50 pro rata cash payment, with no proof required. 

The final amount of each class member’s cash payout may increase or decrease depending on the total number of valid claims filed, among other factors. 

Lastly, in addition to any other settlement benefits, DaVita class members can claim three years of one-bureau credit monitoring, which includes dark web monitoring and identity theft insurance.

The court will determine whether to grant final approval to theDaVita data breach settlement following a hearing in February 2027 or later. Class action settlement benefits will begin to be distributed after the deal receives final approval and any appeals are resolved. 

The DaVita lawsuit alleged that the major healthcare provider failed to adequately protect millions of patients’ sensitive information from a ransomware attack in April 2025. Per court documents, the incident impacted current and former patients’ names, addresses, Social Security numbers, health insurance information, clinical information, treatment details, lab results and more.
