TracFone Settlement Resolves Class Action Lawsuit Over December 2021 Data Breach

TracFone settles a class action lawsuit that alleged hackers accessed customers' personal data in a December 2021 data breach.
A settlement is set to resolve a class action lawsuit filed against TracFone Wireless Inc. over a December 2021 data breach in which hackers accessed thousands of customers’ personally identifiable information (PII) and customer proprietary network information (CPNI).

The TracFone Wireless Inc. data breach settlement, which received preliminary court approval on March 27, 2025, covers all individuals who were affected by the TracFone data breach, including current or former TracFone Wireless, Straight Talk, Simple Mobile, Net10 Wireless, Wal-Mart Family Mobile and Total Wireless customers.

Individuals affected by the data breach, i.e., class members, who file a timely, valid claim form with accompanying documentation can receive up to $3,250 per person for unreimbursed, out-of-pocket “ordinary” losses related to or resulting from the TracFone data breach. “Ordinary” losses can include unreimbursed bank fees, phone charges, postage, credit freeze or credit monitoring costs and more.
TracFone class members who submit a claim form for “ordinary” loss reimbursement can also recover compensation for up to 15 hours of lost time spent dealing with the data breach, at a rate of $30 per hour.
TracFone settlement class members may, alternatively, submit a claim form to receive up to $50,000 in compensation for “extraordinary losses” fairly traceable to the data breach, should those loses exceed the $3,250 “ordinary” loss reimbursement.
Additionally, class members who submit a claim form are eligible to receive three years of one-bureau credit monitoring, including $1,000,000 in identity theft insurance, the settlement website shares.
Lastly, class members may submit a claim form to recover “lost business opportunity costs,” which include “any lost potential net revenue” caused by a class member’s inability to use their phone for business purposes due to the TracFone data breach.
To submit a TracFone claim form online, head to this page on the settlement website and log in by entering your Unique ID, which should be available in the original settlement notice you may have received.
Alternatively, you can submit a claim via mail by downloading a PDF version of the TracFone claim form to print, complete, and mail to the address listed near the top of the first page.
All TracFone data breach settlement claims must be submitted by August 7, 2025.
There will be a hearing on September 16, 2025 to determine whether the court grants final approval to the settlement. Should the settlement receive final approval, class members will begin to receive their compensation within 30 of the final approval either via mailed check or electronic transfer, the settlement site states.
The TracFone Wireless Inc. class action lawsuit alleged that TracFone failed to properly secure customers’ personally identifiable information and customer proprietary network information and left it susceptible to hackers. The class action suit said the TracFone data breach occurred between December 2021 and March 2022, and that the company “misled customers” as to the nature of the incident.
