Toyota, Analytics Co. Illegally Shared Driver Data with Progressive Insurance, Class Action Lawsuit Claims

A proposed class action lawsuit alleges Toyota and Connected Analytic Services have for years collected and sold to third parties, including Progressive Casualty Insurance Company, “vast amounts of location and vehicle data” without drivers’ consent or knowledge.

The 28-page privacy lawsuit accuses the automaker and Connected Analytic Services (CAS), a consumer reporting agency and data aggregator, of capturing from certain Toyota vehicles data concerning drivers’ location, speed, direction, braking and swerving/cornering events and image and voice information, among other personally identifiable details, and sharing that information with insurance providers, marketing agencies, law enforcement and auto finance companies.
The driver data at issue is allegedly captured and sold to third parties without proposed class members’ consent, “regardless of whether any particular car functions are turned on,” and in violation of privacy law, the filing claims.
“Defendants Toyota, Progressive, and CAS all claim in their respective policies about sharing Driving Data … that they do not share Driving Data of Plaintiff and Class Members without their consent,” the case reads. “[H]owever, Defendants’ claims in their Data Sharing Policies are false.”
In particular, Toyota shares driver data with Progressive through the insurer’s Snapshot program, for which Progressive claims a driver’s consent is first required before any data sharing can happen, the lawsuit states. Though Toyota and Progressive acknowledge that consumers who have bought certain 2018 and newer Toyota vehicles may have their data tracked by the automaker and shared with the insurer, many drivers have never provided their consent, the case alleges.
With regard to CAS, the class action suit calls its purported commitment to protecting driver data and privacy “untrue.”
The plaintiff, a Florida consumer, says that the 2021 Toyota RAV4 XLE he purchased was equipped with a “telemetry” device that can track and collect driving data. In January 2025, the consumer attempted to sign up for a Progressive insurance policy through the company’s website, upon which he opted out of Progressive’s Snapshot data sharing program, the suit says.
After opting out of the program online, however, a pop-up window appeared and notified the plaintiff that “Progressive was already in possession of his Driving Data” up to January 20 of this year, the lawsuit says.
Toyota did not inform the plaintiff that it would share his driving data with third parties, the suit relays, and the man learned upon calling Toyota that he had apparently unknowingly signed up for a trial of sharing his driver data when he bought his vehicle.
The Toyota class action lawsuit looks to cover all individuals in the United States who owned or leased a model year 2018 or newer Toyota vehicle equipped with tracking technology.
