The City of Hughes, Arkansas has been hit with a collective action filed by an employee who claims he was not appropriately compensated for overtime work performed at the city’s water department.
Under federal and state law, public agencies may provide employees with compensatory time off in lieu of overtime wages, the lawsuit explains. The suit alleges that the defendant, however, maintains a policy of providing compensatory time off at a rate of one hour for each overtime hour an employee works, rather than at the proper rate of one and one-half hours. Under this policy, the plaintiff claims he regularly clocked over 40 hours each week without sufficient compensatory time off and, consequently, was not paid for all hours worked.
