A forklift operator claims R&L Carriers Shared Services paid workers a straight-time rate for all hours worked, even for hours they worked over 40 in a week.
A forklift operator and truck unloader employed by R&L Carriers Shared Services, LLC has filed a proposed collective action against the company alleging he and other workers are owed unpaid overtime wages. The plaintiff claims he is paid at his straight-time rate for all hours worked over 40 each workweek, and not at the time-and-a-half rate required by the Fair Labor Standards Act (FLSA). The lawsuit says the plaintiff, who has been employed by the defendant for 39 weeks, works 50 hours per week without proper wages, totaling more than $7,500 in unpaid overtime.
