The plaintiff notes proposed class members were paid a straight 23 percent of a job’s total value by the defendant. This rate, the lawsuit alleges, remained static regardless of whether drivers worked more than 40 hours in a week. Moreover, the defendant, which specializes in hauling landscaping supplies, allegedly would not allow employees to clock in until their trucks were loaded up, for which they would routinely have to wait more than an hour before receiving materials to deliver.
