Over $117M Pork Producer Antitrust Settlements Resolve Lawsuit Over Alleged Price-Inflation Conspiracy

Five major United States pork producers, including Tyson, Triumph and Hormel, and data-analytics firm Agri Stats have agreed to a combined settlement of over $117 million to resolve antitrust litigation that alleged the companies conspired to limit the supply of pork and increase prices in the market.

Eligible to participate in the 117,065,000 pork antitrust settlements are all individuals and entities who indirectly purchased (such as at a grocery store) raw pork bacon or raw pork (fresh or frozen) made from bellies, loins, shoulder, ribs, or pork chops for personal consumption between June 28, 2014 and June 30, 2018 in one of the following states/jurisdictions:

• Arizona;
• California;
• District of Columbia;
• Florida;
• Hawaii;
• Illinois;
• Iowa;
• Kansas;
• Maine;
• Michigan;
• Minnesota;
• Missouri;
• Nebraska;
• Nevada;
• New Hampshire;
• New Mexico;
• New York;
• North Carolina;
• North Dakota;
• Rhode Island;
• South Carolina;
• Tennessee;
• Utah; and
• West Virginia.

Court documents specify that pork products marketed as organic, no-antibiotics ever (NAE), and any products other than bacon that are marinated, seasoned, flavored or breaded are not included in the class action settlement. 

Settlement class members who are unsure whether the pork products they purchased are covered by the settlement can use the product eligibility lookup tool to determine if they are eligible to participate.

Class members who submit a timely, valid claim form can receive a pro rata cash payment proportional to the amount of pork products they purchased between June 28, 2014 and June 30, 2018. 

To submit a pork antitrust settlement claim form online, class members can head to this page and complete each field concerning contact information, purchase information, and preferred method of payment. Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator. 

All pork antitrust settlement claim forms must be submitted online or postmarked by October 29, 2026.

The court will determine whether to grant final approval to the pork antitrust settlement following a hearing on December 11, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The pork antitrust class action lawsuit alleged that a group of major U.S. pork processors, including JBS, Clemens, Hormel, Seaboard, Smithfield, Triumph and Tyson, conspired to limit the supply of pork and inflate pork prices through the use of Agri Stats, a data-sharing company, as well as production restraints and the use of exports, in violation of the federal Sherman Antitrust Act and a host of state antitrust laws.

Per court documents, JBS and Smithfield had already agreed to class action settlements to resolve the allegations against them, and the claims period for those settlements has closed. The settlements detailed on this page resolve claims against Agri Stats, Clemens, Hormel, Seaboard, Triumph and Tyson.

Per court records, Clemens has agreed to a $13.5 million settlement, Hormel has agreed to a $4.46 million deal, and Seaboard has agreed to a $10 million settlement. In addition, Triumph signed on to a $4.1 million deal, and Tyson has agreed to an $85 million settlement. Agri Stats has agreed to certain business practice reforms and will not pay any money through the settlement.
